Purpose

Key Responsibilities:
- Leading and supporting commercial elements of the capability lifecycle, including procurement planning, tendering and contract formation, contract management and closure of contracts ensuring compliance with legislation, procurement policies, processes and procedures across all contract development and management activities as needed.
- Providing advice, direction, assistance and services for procurement policy, technical, commercial, legal, financial investigation and other requirements to support contract development/management outcomes.
- Applying experience to Product/Project teams to ensure delivery of quality procurement related documentation including templates, schedule, correspondence, reports, submissions, plans and strategies.
- Collaborating with other CASG entities such as Materiel Procurement, Financial Investigative Services (FIS) / Commercial and Financial Analysis (CFA) and Legal.
- Building and sustaining productive relationships with Executives, Product/Project Managers and team members, and providing high level commercial SME advice.
- Supporting the Contact Management Officers and Contract Development Officers with mentoring, advice, providing guidance and assisting with training and personal development planning to grow commercial acumen of the team.
- Provide input into, and clearance of, key planning documents including Smart Buyer documentation, Endorsements to Proceed, Intellectual Property Needs Analysis, and Liability Risk Assessments.
Contract Management:
- Undertake normal contract management activities, including payments, cost tracking, monitor deliverables and contractor reporting, manage export controls (utilising CASG)
- Confirm commercial requirements and contract deliverables are satisfied including contract establishment artefacts such as financial guarantees, insurance and deeds.
- Advise and/or provide guidance to business areas on the management of relationships with Contractors and internal stakeholders / customers.
- Support contract meetings, forums and activities.
- Contribute to the development of Contract Management Plans.
- Review/Draft correspondence with contractors.
- Review and analyse commercial Contract Deliverables (e.g. IP Plans).
- Provide commercial advice and support in resolving disputes and evaluating and negotiating claims, including coordinating the provision of legal support.
- Provide Input to reporting, Project Performance Reviews, Award Term Reviews, Periodic Cost Reviews and True Up activities.
- Advise on contract amendments, including reviewing/ drafting necessary documentation.
- Facilitate Survey & Quotes / Contract Change Proposals / Task Priced Service activities as required.
- Coordinate specialist advice and support including, legal, technical, negotiation support and financial.
- Ensure that contract has been fully performed, and all outstanding commercial elements have been met.
- Draft/update commercial elements of Approach to Market (ATM) pack, including conditions of tender and conditions of contract.
- Review technical specification, SOW and associated annexes to ensure consistency with commercial elements of Approach to Market pack.
- Prepare and/or assist with the preparation of documentation including the Tender Evaluation Plan (TEP), AusTender notifications and Probity Protocols.
- Contribute to the establishment of tender evaluation organisation by providing suitably skilled and experienced personnel for the tender evaluation organisation.
- Coordinate key stakeholders, and specialist commercial advisers.
- Provide commercial input into any industry briefings or similar engagements with industry either prior to or after release of the Approach to Market pack.
- Contribute to the evaluation of the commercial elements of the tender responses.
- Evaluate commercial aspects of tender responses as per Request Documentation.
- Provide commercial input to any report or product required as part of activity.
- Advise on the process for notification of successful/unsuccessful tenderers.
- Provide ad-hoc commercial advice in respect of any tenderer complaints or similar matter.
- Assist with the commercial elements of planning for any ODIA activity.
- Provide strategic and tactical commercial advice with respect to formulation of negotiation positions and Contract Negotiation Directive (CND).
- Conduct commercial elements of contract negotiations, including leading commercial negotiation team and identify appropriate external lead negotiator (where required).
- Obtain SME endorsement for changes to templates, including MPB/legal clearance liability, insurance and IP provisions.
- Assist in obtaining all Government approvals/endorsements e.g. Second Pass Approval.
- Obtain approval for any contingent liability as required.
- Provide ad-hoc commercial advice with respect to matters such as execution of contract documents.
- Assist compliance with statutory reporting and notification requirements (e.g. AusTender).
- Assist provision of tender debriefings (where not already provided).
- Confirm that the Contract reflects the outcomes of negotiation and necessary approvals have been exercised and the Contract correctly executed.
